These Terms of Service (the "Terms") govern your use of the BYAKKO service (the "Service"), between you and BYAKKO ("we", "BYAKKO"). By accessing or using the Service, you agree to these Terms.
BYAKKO is a software-as-a-service (SaaS) that, via API, helps detect and quarantine threats such as data poisoning, prompt injection, and embedding poisoning targeting the vector store / RAG knowledge base of AI systems. The Service is provided "as is", and we continuously update and improve its detection capabilities.
You must provide accurate registration information and keep your API key secure. You are responsible for all activity conducted under your account or key. You must be of legal age of majority in your jurisdiction and have authority to contract on behalf of your organization.
You agree not to use the Service for any unlawful purpose, and not to: (a) circumvent usage limits or security mechanisms; (b) perform unauthorized penetration or interference with the Service; (c) resell the Service without our written consent; (d) upload content you have no lawful right to process.
Paid plans are billed monthly by subscription, with plans and prices as listed on the pricing page. Payments are processed by our payment partner Dodo Payments (as Merchant of Record); enterprise plans may be processed by Paddle. Unless otherwise agreed, subscriptions renew automatically at the end of each period, and you may cancel before the next billing cycle. Applicable taxes may be added.
Refunds are handled per our Refund Policy, which is incorporated into these Terms.
All rights in the Service, its software, threat-intelligence database, and brand belong to us or our licensors. Anything not expressly granted in these Terms is reserved. You retain rights to the content you submit.
We strive to maintain high availability, but do not guarantee uninterrupted or error-free operation. A formal service-level agreement (SLA) applies only on the Enterprise plan and when agreed in writing.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. BYAKKO is one layer in defense-in-depth and cannot guarantee detection or blocking of all attacks; you should maintain your own security controls and best practices.
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages; our aggregate liability is capped at the amount you paid for the Service in the twelve (12) months preceding the claim.
You may stop using and cancel your subscription at any time. If you breach these Terms, we may suspend or terminate your access.
We may update these Terms from time to time. Material changes will be notified by reasonable means. Continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by and construed in accordance with the laws of Taiwan, without regard to its conflict-of-law rules.
